These Terms of Use ("Terms") govern your access to and use of afterhourspsychiatrycare.org and any related pages, content, features, communications, or services made available by After Hours Psychiatry Care. By using the website, you agree to these Terms. If you do not agree, do not use the website.
1. Important Emergency Notice
This website is not an emergency service and is not intended to replace 911, 988, the emergency room, or another immediate source of crisis help. If you believe you are experiencing a medical or psychiatric emergency, if you may harm yourself or others, or if you need immediate assistance, call 911, call or text 988, or go to the nearest emergency room immediately.
2. Eligibility and Geographic Limitations
Our services are intended for individuals who are physically located in Florida at the time services are provided, except where we expressly determine that services may lawfully be provided elsewhere. We may request information needed to verify your age, identity, consent authority, and physical location. Not every visitor is eligible for services, and we reserve the right to decline or discontinue services when legally required or clinically appropriate.
If we provide services to a minor, the involvement and consent of a parent, legal guardian, legal custodian, or other authorized representative may be required except where law provides otherwise.
3. Website Information Is Not Medical Advice
Website content is provided for general informational purposes only. Viewing the website, reading content, sending an inquiry, or downloading materials does not by itself create a provider-patient relationship, establish a duty to treat, or guarantee that a clinician will respond or accept you for care. A provider-patient relationship generally begins only after we have determined that services can lawfully and appropriately be provided, the necessary intake and consent steps have been completed, and the interaction has otherwise been accepted by the Practice.
4. Telehealth and Technology
Services may be delivered by telehealth, including through Doxy.me or another platform selected by the Practice. You are responsible for using a compatible device, a reasonably secure internet connection, and a private setting when appropriate. Telehealth can involve limitations and risks such as technical failures, interruptions, security incidents, or the inability to perform certain assessments remotely. We are not responsible for problems caused by your device, internet service, power failure, browser settings, or other circumstances outside our reasonable control.
5. Accurate Information and Lawful Use
You agree to provide accurate, current, and complete information when contacting us or requesting services, and to update information as needed. You may use the website only for lawful purposes and only in a manner that does not interfere with the security, integrity, functionality, or availability of the website or our services.
You may not attempt to gain unauthorized access to the website or our systems; copy, scrape, or harvest content or data without permission; upload malicious code; impersonate another person; submit false or misleading information; violate another person’s privacy or intellectual property rights; or use the website to harass, threaten, or abuse any person.
6. Communications, Recordings, and Consent
By providing contact information, communicating with us, scheduling, or using the website, you acknowledge that we may contact you by phone, text, email, voicemail, and other electronic means for service-related purposes and, where permitted or where required consent is obtained, for promotional communications. Calls, forms, and sessions may be recorded or monitored as described in our Privacy Policy and Communications and Recording Policy. Where notice or consent is required for recording or certain electronic communications, we intend to provide or obtain it as required by law.
If you do not want to receive promotional communications, follow the opt-out instructions in the message or contact us using the information below. Opting out of promotional messages does not prevent us from sending service-related, billing, legal, or safety communications.
7. Privacy
Your use of the website is also subject to our Privacy Policy and, when applicable, our Notice of Privacy Practices. Those documents describe how we collect, use, share, and protect information. If a conflict exists between these Terms and the Notice of Privacy Practices with respect to protected health information, the Notice of Privacy Practices controls to the extent required by law.
8. Fees, Self-Pay, and Payment Processing
Unless we state otherwise in writing, services are offered on a self-pay basis. Fees, deposits, cancellation terms, refund policies, and payment timing may be explained before services are provided or in separate patient documents. We may use third-party payment processors to collect or process payments. You agree to pay all charges incurred in connection with your requested services, subject to any applicable refund or cancellation policy.
9. No Guarantee of Availability or Outcome
We do not guarantee the availability of a specific provider, appointment time, communication response time, medication outcome, prescription decision, diagnosis, treatment result, or website uptime. Clinical decisions are made in the provider’s professional judgment and may depend on patient safety, applicable law, available information, and other factors. We may modify, suspend, or discontinue website features or services at any time.
10. Intellectual Property
Unless otherwise stated, the website and its content, including text, graphics, logos, layout, and other materials, are owned by or licensed to After Hours Psychiatry Care and are protected by applicable intellectual property laws. You may view and print reasonable portions for personal, noncommercial use only. You may not reproduce, distribute, modify, publicly display, or create derivative works from website content without prior written permission, except as allowed by law.
11. Third-Party Services and Links
The website may link to third-party services or use third-party platforms, including telehealth vendors, payment processors, mapping tools, forms, email services, analytics tools, social media, or other technologies. We do not control and are not responsible for third-party content, policies, security, or practices except to the extent expressly stated in our own policies. Your use of third-party services may also be governed by their terms and notices.
12. Disclaimers
The website and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We make no representation or warranty that the website will always be uninterrupted, secure, error-free, accurate, complete, or suitable for every purpose. Nothing in these Terms is intended to limit rights that cannot lawfully be waived or disclaimed under applicable law.
13. Limitation of Liability
To the fullest extent permitted by applicable law, the Practice and its owners, clinicians, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of the website. This limitation does not apply where liability cannot lawfully be limited. These Terms do not limit or waive duties owed in the actual provision of professional health care services to the extent such duties cannot lawfully be limited.
14. Indemnification for Misuse
You agree to indemnify and hold harmless the Practice and its owners, clinicians, employees, contractors, and agents from claims, losses, liabilities, damages, or expenses arising from your unlawful use of the website, your violation of these Terms, your violation of another person’s rights, or your submission of false, misleading, or unauthorized information, to the extent permitted by law.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any dispute arising from or relating to these Terms or the website shall be brought in a court of competent jurisdiction located in Osceola County, Florida.
16. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the website. The updated Terms become effective when posted unless another effective date is specified. Your continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms.
17. Contact Information
